Usmernenia sú vydané podľa článku 16 nariadenia Európskeho parlamentu a Rady (EÚ) č. 1095/2010 z 24. novembra 2010, ktorým sa zriaďuje Európsky orgán dohľadu (Európsky orgán pre cenné papiere a trhy) a ktorým sa mení a dopĺňa rozhodnutie č. 716/2009/ES a zrušuje rozhodnutie Komisie 2009/77/ES.
