Statement from the NBS Bank Board's 4th meeting of 2018

The Bank Board of Národná banka Slovenska today (6 February) held its 4th meeting of 2018, chaired by Jozef Makúch, the NBS Governor.

The Bank Board approved a Decree of Národná banka Slovenska amending Decree No 16/2011 of Národná banka Slovenska on the elements of an authorisation application for a bank or foreign bank branch and on how to demonstrate compliance with the conditions for the authorisation.

The purpose of the new Decree is to take account of changes resulting from the amendment of the Banking Act (No 483/2001 Coll.) by Act No 279/2017 Coll., specifically the cancellation of the current mechanism for authorising banks to conduct mortgage business.

The Decree will enter into force on 1 March 2018.

The Bank Board approved a Decree of Národná banka Slovenska amending Decree No 6/2010 of Národná banka Slovenska laying down the elements of an application for the prior approval of Národná banka Slovenska under Article 28(1) of the Banking Act.

The purpose of the new Decree is to take account of changes resulting from the amendment of the Banking Act (No 483/2001 Coll.) by Act No 279/2017 Coll.

The Decree will enter into force on 1 March 2018.

The Bank Board approved a Decree of Národná banka Slovenska on how to demonstrate compliance with conditions for an authorisation to pursue the activity of an independent financial agent and for an authorisation to pursue the activity of a financial adviser.

The Decree specifies how both natural persons and legal entities are to demonstrate compliance with conditions for an authorisation to pursue the activity of a financial agent and for an authorisation to pursue the activity of a financial adviser. The conditions that applicants must satisfy include meeting fit and proper requirements and being suitably qualified; in the case of applicants that are legal entities, these conditions must be met by their statutory body and by their employees who will be performing activities involving financial intermediation or the provision of financial advisory services. Applicants must also meet the technical and organisational requirements for performing the respective activities. Applicants that are legal entities are additionally required to submit a graphical representation of their group’s structure including information about its members and their participating interests, and also to submit a list of natural persons that have a qualifying holding in the applicant and legal entities that have a qualifying holding in the applicant.

The Decree will enter into force on 23 February 2018.
